If you have saved up paid leaves at your job and don&#x2019;t use them, your employer may pay you for those days when you leave the job or retire.<\/p>\n\n\n\n<p>Think of it like this:<br>Imagine you had 30 days of leave left, but you didn&#x2019;t take them. When you quit or retire, your company says, &#x201C;Here&#x2019;s the salary for those 30 days.&#x201D;<\/p>\n\n\n\n<h2 id=\"is-leave-encashment-taxable\" class=\"wp-block-heading\">Is Leave Encashment <a class=\"glossaryLink\"  href=\"https:\/\/lemonn.co.in\/blog\/glossary\/tax\/\"  data-gt-translate-attributes='[{\"attribute\":\"data-cmtooltip\", \"format\":\"html\"}]'  tabindex='0' role='link'>Tax<\/a>able?<\/h2>\n\n\n\n<p>Yes &#x2013; <strong>but only partly.<\/strong><br>Some portion of this money is <strong>tax-free under Section 10(10AA)<\/strong> of the <a class=\"glossaryLink\" href=\"https:\/\/lemonn.co.in\/blog\/glossary\/income-tax-act\/\" data-gt-translate-attributes='[{\"attribute\":\"data-cmtooltip\", \"format\":\"html\"}]' tabindex=\"0\" role=\"link\">Income Tax Act<\/a>, depending on:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Whether you work in the <strong>government<\/strong> or <strong>private <a class=\"glossaryLink\"  href=\"https:\/\/lemonn.co.in\/blog\/glossary\/sector\/\"  data-gt-translate-attributes='[{\"attribute\":\"data-cmtooltip\", \"format\":\"html\"}]'  tabindex='0' role='link'>sector<\/a><\/strong><\/li>\n\n\n\n<li>If you&#x2019;re <strong>retiring<\/strong>, <strong>resigning<\/strong>, or <strong>leaving the job<\/strong><\/li>\n<\/ol>\n\n\n\n<h2 id=\"tax-rules-for-government-employees\" class=\"wp-block-heading\">Tax Rules for Government Employees<\/h2>\n\n\n\n<p>If you work for the <strong>Central or State Government<\/strong>, your entire leave encashment is <strong>fully tax-free<\/strong>, no matter how much it is.<\/p>\n\n\n\n<h2 id=\"tax-rules-for-private-sector-employees\" class=\"wp-block-heading\">Tax Rules for Private Sector Employees<\/h2>\n\n\n\n<p>If you work in the <strong>private sector<\/strong>, the leave encashment amount is <strong>partly tax-free<\/strong>, and the rest is taxed. You can get <strong>exemption on the lowest of the following four<\/strong>:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Actual leave encashment received<\/strong><\/li>\n\n\n\n<li><strong>&#x20B9;3,00,000<\/strong> (maximum limit set by the government)<\/li>\n\n\n\n<li><strong>10 months&#x2019; average salary<\/strong> before leaving<\/li>\n\n\n\n<li><strong>Cash equivalent of leave balance<\/strong>, up to 30 days leave per year of service<\/li>\n<\/ol>\n\n\n\n<h2 id=\"simple-example\" class=\"wp-block-heading\">Simple Example:<\/h2>\n\n\n\n<p>Let&#x2019;s say Raj works at a private company. He retires with 240 days (8 months) of unused leave. His average monthly salary is &#x20B9;50,000.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Actual leave encashment: &#x20B9;4,00,000<\/li>\n\n\n\n<li>10 months&#x2019; salary: &#x20B9;5,00,000<\/li>\n\n\n\n<li>Leave for 30 days per year of 20 years = 600 days. He used 360 days, so 240 days left = 8 months = &#x20B9;4,00,000<\/li>\n\n\n\n<li>Maximum allowed by law: &#x20B9;3,00,000<\/li>\n<\/ul>\n\n\n\n<p><strong>Tax-free amount = &#x20B9;3,00,000<\/strong> (the lowest of the above)<br>Remaining &#x20B9;1,00,000 is taxable<\/p>\n\n\n\n<h2 id=\"few-more-points\" class=\"wp-block-heading\">Few More Points:<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The &#x20B9;3 lakh exemption is a <strong>lifetime limit<\/strong>. If you&#x2019;ve claimed it once, you can&#x2019;t claim again.<\/li>\n\n\n\n<li>If you get leave encashment <strong>while still working<\/strong>, it&#x2019;s fully <strong>taxable<\/strong>.<\/li>\n\n\n\n<li>Always ask for a <strong>salary certificate or breakup<\/strong> to calculate the exact exempt amount.<\/li>\n<\/ul>\n\n\n\n<h2 id=\"final-thoughts\" class=\"wp-block-heading\">Final Thoughts<\/h2>\n\n\n\n<p>Leave encashment is a helpful bonus when leaving your job or retiring. Section 10(10AA) offers a <strong>tax relief<\/strong>, especially for long-serving employees.
