When a lien is marked, you cannot prematurely close or withdraw the FD until the lien is removed. Banks typically mark a lien when you take a loan or overdraft against your FD as security.

What Is Lien Marking on FD?

When you use your fixed deposit as collateral for a loan, the bank places a lien on it. This means the bank has a legal claim over the FD for the duration of the loan. The FD continues to earn interest normally, but you cannot break it or withdraw from it without the bank’s permission as long as the lien is active.

A lien is different from pledging the FD. With a pledge, you hand over ownership partially. With a lien, you retain ownership but the bank has the right to recover the loan amount from the FD if you default.

When Is a Lien Marked?

Common situations where a bank marks a lien on your FD:

– **Loan against FD** – you borrow against the FD as security
– **Overdraft against FD** – you use the FD to get an overdraft limit
– **Credit card issuance** – secured credit cards are backed by a lien-marked FD
– **Court orders** – a court may direct the bank to place a lien on an FD during a legal dispute
– **Tax dues** – income tax or GST authorities can request a lien on an FD for outstanding dues

Impact on the FD

– Interest continues to accrue normally
– You cannot close the FD before maturity while the lien is active
– You cannot use the FD for another loan simultaneously unless the lender agrees
– On maturity, the loan amount is recovered from the FD proceeds if outstanding

How to Get a Lien Removed

Once you repay the loan or fulfill the obligation for which the lien was created, the bank removes the lien. This is called lien removal or release. You may need to make a written request at the branch or it may happen automatically upon loan closure.

Practical Example

Vikram takes a loan of Rs 4 lakh against his Rs 5 lakh FD. The bank marks a lien for Rs 4 lakh on the FD. Vikram continues to earn interest on the full Rs 5 lakh. However, he cannot prematurely close the FD until he repays the loan. Once he repays the loan in full, the bank releases the lien and Vikram can operate the FD freely again.

Key Takeaways

– A lien on an FD is a legal hold that prevents you from withdrawing or closing it
– Banks mark liens when FDs are used as collateral for loans, overdrafts, or secured credit cards
– The FD continues to earn interest even with a lien marked
– The lien is removed automatically or on request once the underlying obligation is cleared
– Tax authorities and courts can also direct lien marking in specific situations

A lien on a fixed deposit is a legal hold placed by the bank on your FD.
