If you sell a property for less than its government-assessed stamp duty value, your <a class=\"glossaryLink\" href=\"https:\/\/lemonn.co.in\/blog\/glossary\/capital-gains-tax\/\" data-gt-translate-attributes='[{\"attribute\":\"data-cmtooltip\", \"format\":\"html\"}]' tabindex=\"0\" role=\"link\">capital gains tax<\/a> may be calculated on the higher stamp duty value, not on what you actually received. Here is what you need to understand before you sell any land or building.<\/p>\n<h2 id=\"what-is-section-50c\">What is Section 50C?<\/h2>\n<p>Section 50C applies to the transfer of land, buildings, or both. It states that if the sale consideration you declare for the transfer is less than the stamp duty value of the property, the stamp duty value is treated as the full value of consideration for computing <a class=\"glossaryLink\" href=\"https:\/\/lemonn.co.in\/blog\/glossary\/capital-gain\/\" data-gt-translate-attributes='[{\"attribute\":\"data-cmtooltip\", \"format\":\"html\"}]' tabindex=\"0\" role=\"link\">capital gain<\/a>s.<\/p>\n<p>In simple terms: if you sell a property for Rs. 50 lakhs but the stamp duty authority values it at Rs. 70 lakhs, your capital gain is calculated as though you sold it for Rs. 70 lakhs. This can significantly increase your <a class=\"glossaryLink\"  href=\"https:\/\/lemonn.co.in\/blog\/glossary\/tax\/\"  data-gt-translate-attributes='[{\"attribute\":\"data-cmtooltip\", \"format\":\"html\"}]'  tabindex='0' role='link'>tax<\/a> liability even though you never actually received that higher amount.<\/p>\n<h2 id=\"why-was-section-50c-introduced\">Why Was Section 50C Introduced?<\/h2>\n<p>The section was introduced to prevent the widespread practice of underreporting property transaction values in sale deeds. In India, sellers and buyers often showed artificially low prices in documents to reduce stamp duty and capital gains tax. By linking the minimum deemed sale price to the government-set stamp duty value (also called circle rate or guidance value), Section 50C makes underreporting ineffective.<\/p>\n<h2 id=\"the-10-safe-harbour\">The 10% Safe Harbour<\/h2>\n<p>To protect genuine sellers where the actual price is slightly below the stamp duty value due to market conditions, a safe harbour was introduced by the Finance Act 2020.<\/p>\n<p>Under the current rule, if the actual sale price is at least 90% of the stamp duty value, the actual sale price is used for computing capital gains, not the stamp duty value.<\/p>\n<p>For example, if you sell a property for Rs. 65 lakhs and the stamp duty value is Rs. 70 lakhs, the ratio is 92.8%, which is above 90%. You use Rs. 65 lakhs for capital gains computation.<\/p>\n<p>But if you sell for Rs. 60 lakhs (85.7% of Rs. 70 lakhs, below 90%), then Rs. 70 lakhs is used.<\/p>\n<h2 id=\"disputing-the-stamp-duty-value\">Disputing the Stamp Duty Value<\/h2>\n<p>If you believe the stamp duty value is unreasonably high, you can dispute it. The Assessing Officer is required to refer the matter to the <a class=\"glossaryLink\" href=\"https:\/\/lemonn.co.in\/blog\/glossary\/income-tax\/\" data-gt-translate-attributes='[{\"attribute\":\"data-cmtooltip\", \"format\":\"html\"}]' tabindex=\"0\" role=\"link\">Income Tax<\/a> Valuation Officer for an independent valuation. The valuation date is typically the date of registration of the sale deed.<\/p>\n<p>If the Valuation Officer&#x2019;s assessment is lower than the stamp duty value, the lower of the two figures is used for Section 50C purposes.<\/p>\n<h2 id=\"impact-on-the-buyer\">Impact on the Buyer<\/h2>\n<p>Section 50C has a corresponding impact on the buyer through Section 56(2)(x). If you buy a property below its stamp duty value and the difference exceeds 10%, the difference is treated as taxable income in the buyer&rsquo;s hands. Both sides of an undervalued property transaction can therefore face tax co<a class=\"glossaryLink\"  href=\"https:\/\/lemonn.co.in\/blog\/glossary\/nse\/\"  data-gt-translate-attributes='[{\"attribute\":\"data-cmtooltip\", \"format\":\"html\"}]'  tabindex='0' role='link'>nse<\/a>quences under current law.<\/p>\n<h2 id=\"practical-example\">Practical Example<\/h2>\n<p>Priya sells her apartment for Rs. 55 lakhs. The stamp duty value is Rs. 70 lakhs. The ratio is 78.5%, below the 90% threshold. Under Section 50C, her capital gain is computed on Rs. 70 lakhs, not Rs. 55 lakhs. She pays higher capital gains tax than she would have expected based on the actual amount she received.<\/p>\n<h2 id=\"applies-to-long-term-and-short-term-both\">Applies to Long-Term and Short-Term Both<\/h2>\n<p>Section 50C applies to both long-term and short-term capital gains from the transfer of immovable property.
